By downloading, accessing, or using Use It Up (the “app”) you agree to these Terms of Use. If you do not agree, do not use the app.
Use It Up helps you track food, get AI-assisted food scanning, freshness and ripeness estimates, recipe ideas, and nutrition logging. You are responsible for keeping your account secure and for the accuracy of the information you add.
Parts of the app are powered by artificial intelligence — including food and barcode scanning, label reading, freshness and ripeness estimates, recipe generation, and the in-app assistants. AI output is generated automatically, is probabilistic, and can be inaccurate, incomplete, or entirely wrong. The AI may misidentify a food, misjudge how fresh or ripe it is, miscalculate nutrition, invent ingredients or steps, or omit important information. AI results are suggestions only — not statements of fact, professional advice, or guarantees. You must independently verify anything that matters before relying on it.
Do not rely on the app to identify allergens or to confirm that a food or recipe is safe for any allergy, intolerance, or dietary restriction. AI-generated and scanned content may fail to list allergens (such as nuts, dairy, gluten, shellfish, soy, or eggs), may mislabel ingredients, or may suggest substitutions that are unsafe for you. If you or anyone you are cooking for has a food allergy or medical dietary need, always check the original product packaging and ingredient labels and consult a qualified professional. You assume all risk arising from allergens and dietary needs.
Expiry dates, freshness, ripeness, spoilage, and shelf-life information in the app — including AI-generated and scanned estimates — are estimates only and may be wrong. They are not a determination that any food is safe to eat. Always use your own senses and judgment, follow safe food-handling and cooking practices (including proper cooking temperatures), and when in doubt, throw it out. We are not responsible for any illness, injury, or loss resulting from consuming, preparing, storing, or discarding food based on the app.
The app does not provide medical, health, nutritional, or dietary advice and is not a substitute for a qualified professional. Nutrition values are estimates and are not suitable for clinical, medical, or therapeutic use. Consult a doctor, dietitian, or other professional before making decisions about your diet or health, especially for medical conditions, pregnancy, or allergies.
Use It Up offers an optional connection to WHOOP. WHOOP is a third-party service and is not affiliated with, endorsed by, or a sponsor of Use It Up; “WHOOP” is a trademark of its owner, used here only to identify the integration. Your use of WHOOP and your WHOOP data are governed by WHOOP’s own terms and privacy policy. The connection is provided “as is” and may change, be interrupted, or stop working if WHOOP alters or ends its service or API; we do not guarantee its availability. Insights, recovery- or strain-based recipes, refuel targets, and “body signals” derived from WHOOP data are general wellness features and estimates only — they are not medical, clinical, athletic, or professional advice, and the “Not medical, nutritional, or professional advice” section above applies to them in full.
You are solely responsible for how you use the app and its AI output, including all decisions about buying, storing, preparing, cooking, eating, serving, or discarding food. You use the app and rely on any result at your own risk.
Use It Up Pro is an auto-renewing subscription billed through your Apple ID. It renews at the displayed price each period unless cancelled at least 24 hours before the period ends. Manage or cancel anytime in your iOS Settings → Apple ID → Subscriptions. Any free trial converts to a paid subscription unless cancelled before it ends.
Don’t misuse the service, attempt to break or overload it, or use it for unlawful purposes.
The app and all content and AI output are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app or any AI result will be accurate, reliable, complete, error-free, or uninterrupted.
To the maximum extent permitted by law, Use It Up and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, illness, allergic reaction, property damage, food loss, or other loss arising out of or relating to your use of the app or reliance on any AI or scanned output, even if advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the app in the 12 months before the claim, or 50 USD. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you, and you may have additional rights under local law.
You agree to indemnify and hold harmless Use It Up and its developer from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the app, your reliance on AI or scanned output, or your violation of these terms.
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. To the extent permitted by law, any dispute will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction. Nothing in this section removes any protection you have under the mandatory consumer-protection laws of your own place of residence.
We may update these terms; continued use means you accept the changes.
